From that point onwards many initiatives were lined up by MASB and the Malaysian Institute of Accountants (MIA) in order to educate, train and inform all the relevant stakeholders in tandem with fast approaching deadline to converge, which is for the earliest year-end financial reporting date, 31 December 2012. On 19 November 2011, MASB issued the third accounting framework to be applied in Malaysia and this new accounting framework that is IFRS-compliant is dubbed as Malaysian Financial Reporting Standards framework (MFRS). The issuance of MRFS is vital to show and prove the Malaysian commitment and also it becomes a solid guideline for all entities that are administered by Securities Commission of Malaysia and the convergence begin on or after 1 January 2012. Historically, Malaysian accounting standards have always closely followed the former International Accounting Standards (IAS) and the current IFRS. All these three frameworks are legally approved frameworks by MASB and can be applied by entities in Malaysia but subject to the type of entity. The three types of frameworks are outlined and discussed below. MFRS framework is to be applied by all entities other than private entities for annual periods beginning on or after 1 January 2012. Private entities are private companies which are incorporated under the Companies Act 1965, that are not itself required to prepare or lodge any financial statements under any law administered by the Securities Commission Malaysia or Bank Negara Malaysia. Private entities are also not subsidiaries or associates of or jointly controlled by an entity which is required to prepare or lodge any financial statements under any law administered by the securities Commission Malaysia or Bank Negara Malaysia. However ‘Transitioning Entities’ are excluded from applying MFRS and these ‘Transitioning Entities’ are entities that are in the scope of MFRS 141 for ‘Agriculture’ (equivalent to IAS 41) and IC Interpretation 15 for ‘Agreement for Construction of Real Estate’, (equivalent to International Financial Reporting Interpretations Committee (IFRIC) 15) including its parent, significant investor and venture. These ‘Transitioning Entities’ have an option to either apply the MFRS framework or the old FRS framework, but this leeway is only allowed for one year, as these ‘Transitioning Entities’ need to apply the MFRS framework by  Page 43 International Journal of Business, Economics and Law, Vol. 1 ISSN 2289-1552 2012 annual periods beginning on or after 1 January 2013 at the latest (Nazatul Izma, 2009; KPMG, 2011; Accountants Today 2012; Ganespathy, 2012; Jebaratnam, 2012). PERS framework is to be applied only by private entities but these private entities have an option to apply MFRS framework for annual periods beginning on or after 1 January 2012. If the private entities choose to apply MFRS framework and these entities are in the scope of MFRS 141 for ‘Agriculture’ (equivalent to IAS 41) and IC Interpretation 15 for ‘Agreement for Construction of Real Estate’, (equivalent to IFRIC 15), therefore known as ‘Transitioning Entities’, they have the choice to either apply MFRS framework or FRS framework, but these freedom is applicable up to 31 December 2012, as these entities need to revert to MFRS framework for annual periods beginning on or after 1 January 2013 (Accountants Today, 2012; Jebaratnam, 2012). FRS framework which is the Malaysian version of IAS, which has been the main accounting standards framework for nonprivate entities before the introduction of MFRS framework can be applied only by ‘Transitioning Entities’, but as stated earlier, such entities need to revert to MFRS framework for annual periods beginning on or after 1 January 2013 (Accountants Today, 2012; Jebaratnam, 2012) ISSUES AND CHALLENGES IN FULL ADOPTION OF IFRS IN MALAYSIA MFRS 1 covers issues pertaining to ‘First-Time Adoption of Malaysian Financial Reporting Standards’ and the transition date stated in MFRS 1 is the beginning of the earliest period for which an entity presents a full comparative information under MFRSs in its first MFRS based statements. Following the requirement of MFRS 1, MFRS 101 on ‘Presentation of Financial Statements’ requires reporting entities to present three ‘Statements of Financial Position’ and two ‘Statement of Comprehensive Income’, ‘Statements of Changes in Equity’ and ‘Statement of Cash Flows’ each. MFRS also dictates that entities need to present statement of financial position as at the beginning of the comparative financial year, therefore reporting entities requires their financial statements to be prepared based on the requirement of MFRS from the financial year beginning on and after 1 January 2010, or otherwise be very cautious to make retrospective restatements and/or reclassify items in all the financial statements and notes to accounts and the transition date would be on or after 1 January 2011. The expectation is that the entities are able to present MFRS compliant financial statements come the year-end financial reporting on 31 December 2012, which may become an issue, if these entities are not MFRS ‘ready’ (Accountants Today, 2012). Another challenge for full adoption of IFRS in Malaysia is that under MFRS 1, whenever the cost of complying with MFRS exceeds the benefits to the users of financial statements and also if retrospective application would mean that judgement by management of a known transaction is required, IASB would grant exemptions and therefore this would create unlevel playing field amongst non-private entities in Malaysia that are supposed to apply MFRS framework as the criterion for full-adoption. To ensure that the reporting entities in Malaysia are MFRS compliant, these entities should perform a comprehensive, thorough and detailed examination of the readiness of their entity in becoming MFRS compliance to avoid any investigation by the authority due to non-compliance after the grace period for full adoption is over. If Malaysia ends up trimming its MFRS as a convergence framework that can be adapted to fit the local conditions and not a one size fits all set of standards, because a full adoption forces countries to surrender their sovereignty, then Malaysia will have serious issues and will face difficulties to be endorsed as a country that compliances to full IFRS adoption (Nazatul Izma, 2009). But as it is evident, MFRS 141 and IC 15 for ‘Transitioning Entities’ is an exception given to such entities to comply to full IFRS adoption by reverting to MFRS framework for annual periods beginning on or after 1 January 2013. Even though the IAS 41 assumption that fair value can be measured for biological assets was an issue, but this sort of issues should be communicated clearly to the practitioners and this is where the education and training of the practitioners is key for a successful full adoption of IFRS. For example MFRS 141 (IAS 41) disagreement with IASB need to be entirely made clear to the Malaysian practitioners, as IASB currently have agreed to recognise palm oil tree as a non current asset and not as an inventory (Nazatul Izma, 2009). One of the most common perceived advantages of convergence to IFRS is the possibility of increased foreign direct investment (FDI) (Gardiner, 2000; Christiansen, 2002), but as of 2010, report on the most attractive FDI destinations, the world’s highest FDI receivers are China, United States of America and India, of which none have converged to IFRS. Therefore, the notion that IFRS convergence will attract FDI is not valid, and this so called advantage cannot be applied to entice countries to adopt IFRS for financial reporting of their entities. IFRSs for SME is another reason to ponder on the real plausibility of full adoption of IFRS. If MASB chooses to adopt IFRS for SMEs to replace PERS, than we will have another version of ‘diluted’ IFRS as a framework within the Malaysia accounting scenario. Dr Paul Pacter, the board member and chairman of the SME implementation group, mentioned that some topics in the IFRS were omitted from the IFRS for SMEs, due to its irrelevance and also due to the fact that the ‘diluted’ version will be a simpler option for the SMEs to apply (Nazatul Izma, 2010). The IFRS for SMEs were simplified on the recognition and measurement and the disclosures were also reduced. Brian Blood, the Chief Executive of Confederation of Asian and Pacific Accountants (CAPA) mentioned that the IFRS for SMEs were developed to assist SMEs to prepare and present high quality and timely financial statements and information. Other benefits of SMEs applying the IFRS for SMEs are that the financial reporting is done in a consistent manner and not too expensive to prepare (Nazatul Izma, 2010). Having said all that, the fact is that there is a different set of IFRS for SMEs, therefore, it does not allow for full adoption, but maybe just a mere convergence. James Sylph, the executive director, Professional Standards and External Relations of International Federation of Accountants (IFAC) in a forum in 2012, strongly advocated that national accounting standard setters’ authorities and regulators should move away from the mere concept of convergence to a more profound notion of full-adoption. Page 44 International Journal of Business, Economics and Law, Vol. 1 ISSN 2289-1552 2012 Mohammad Faiz Azmi, MASB chairman, indicated that Malaysia will not require the IFRS for SMEs to avoid an ‘underconverged’ version used by SMEs due to the lack of human resources to implement new IFRS based regulations; therefore MASB is still uncertain about how exactly they should deal with the issue related to SME and IFRS (Nazatul Izma, 2010) MASB together with MIA will have to look into the issue of the readiness of the Malaysian education system to deliver enough trained accountants that are IFRS savvy, as a full IFRS adoption can be burdensome and the human capital need to be created to fulfill this need. Mohammad Faiz Azmi mentioned that MASB is working with enforcers to amend the Financial Reporting Act (1997) to allow making amendments to accounting standards in Malaysia if there are any substantial issues that MASB disagrees with IASB (Nazatul Izma, 2009). This again will give some space for MASB for not to adopt the full adoption of IFRS as there will be some possible avenue to make changes in the IFRS provided by IASB. The Motivation Behind the Columbine High Shootings Every major spectacle carries with it the potential of a new way of looking at the past and implications of a future. Usually within a brief period after the event, a consensual "explanation" is fashioned through the news media and by the political pundits who occupy much of the space and time dedicated by the media to the event. Political pundits seated in front of the camera become part of the event, often becoming a part of the process of transforming an event in time to a spectacle. In this case, the event was the murder of 13 and wounding of 23 persons at the Columbine High School in Littleton, Colorado. The event took place on April 22, 1999 and, because of the subsequent suicide of the two teenage perpetrators, observers could only speculate on their motivation. While students were still hiding from the gunmen and while the police were still plotting their strategy, the media coverage began. Perhaps two impulses led to the coverage. First of all, the victims were not the children of the Hutus or East Timorese or even the Kosovos. These were "our" children and the parents our "friends." Their grief could have been ours. In fact, in a month plus a few days, five million dollars were donated to the survivors and the victim families even without there being a major fund-raising drive (Morning Edition, NPR, June 8, 1999). Secondly, the event had the earmarks of a media spectacle, that is, by transmogrifying the event to something beyond itself, the news media knew they would again be able to maximize their profit margins on the grief and graves of others. Events are news stories; spectacles are dollars. The old tv newsroom characterization of "if it bleeds, it leads" has been replaced in their business office à ³from graves to the gravy train. In its societal context, the Columbine school shootings are not an obvious part of a discernible sociological pattern. We know that approximately 4,500 youngsters are killed every year in intentional shootings, with thirty per cent of that number probable suicides. That's almost 13 a day, the same number as were killed in Littleton (The Washington Post, April 25, 1999). The data on school shootings, according to the Center for Communicable Diseases, indicate that only about 28 per cent actually occurred inside the school and that one-third of the victims were not... ...de behind my choices. You need to face the fact that this comes as a result of YOUR CHOICES....You taught these kids not to accept what is different. Harris and Klebold, armed with guns and bombs, grotesquely mobilized what little power they thought they had. Perhaps at another time or in another place these murders would not have occurred. But right now, the issue is power. That is our final lesson. One Georgia school board member -- obviously aware of the issue -- said following the Conyers, GA shooting: "We've got to let these kids know who's in charge of the schools" (New York Times, May 24, 1999). Violence in all of its manifestations is based on an exercise of power. It represents a means to gain power, to maintain power, or as a response to a threat to one's power. As long as a society maintains the legitimacy of social hierarchies, of the right of some people to have power over others, there will be violence. One can either seek to diffuse the concentration of power or to control violence. By its very character, the attempt to control violence is self-defeating. The control will itself become violent. The quest for a society without coercion is only now being charted

In doing so, many resources have been revealed fitting and useful over the course of time to assist us in our daily needs and social settings, allowing us the ability to sustain ourselves throughout history. However, as those resources grow smaller and our economy demands grow greater, we recognize the need to expand the search for other means of re conciliation to survive.In today’s economic struggle and political upheavals, we are ever so more seeking out new ways to take care of our own and retrieve new ways of self-dependence upon resources known to exist; only the means to extract are at hand. As most of us know, one of our most precious and well utilized resources to date is oil, black gold, which found far beneath the earth’s layers, in turn sent the Beverly Hillbillies to stardom. The need for oil and the byproducts that come from it are in great need and the costs are rising daily.Our requirement to ascertain this product has caused some concern and revealed the necessity to seek out new ways of locating this liquid assurance, for meeting our future demands. Although, there may be many ways of retrieving this from beneath the many depths of the earth, there has only been one way, truly effective for reaching areas untouched by normal means, which has become the center cause of debate in recent years. I wi ll, through the use of various reports and studies bring forth analysis and discovery that highlights the use of hydraulic fracturing and the effects hat seem to shadow over this seemingly burdened tactic of extraction. Before immersing ourselves in the myriad of reports, studies, and personal accounts concerning the results of this approach, we should understand what hydraulic fracturing is and the process it takes. Understanding the process, through which this approach is considered, we will be able to seize what the issues are and the potential for ushering in an agreement to a solution. We must first recognize what shale is and what it offers. Is this the answer to our economic future and interdependence on oil?Shale is a very compacted rock with fine sediment that is found to be with a large amount of minerals and other resources. â€Å"Shales are fine-grained sedimentary rocks that can be rich resources of petroleum and natural gas. Sedimentary rocks are rocks formed by the a ccumulation of sediments at the Earth's surface and within bodies of water. Common sedimentary rocks include sandstone, limestone, and shale† (ShaleTech Shale Training and Education Center, 1995). We know that there are many resources we can extract from this area and the plays will require a unique technique to draw the required material out.Plays are noted to be spread out, throughout the United States and furthermore, the other side of the great pond is known to have several locations found to be worthy of the dig. â€Å"Shale gas maps show â€Å"plays† are found throughout the Mountain West, the South and throughout the Northeast's Appalachian Basin. The Barnett shale play in Texas, for example, is 5,000 square miles and provides 6 percent of U. S. natural gas. The Marcellus shale play that stretches across Pennsylvania, New York, Ohio and West Virginia covers ten times the square miles of the Barnett, but has only recently started to be developed† (EnergyFro mShale, 2012).There is much to do, in order to gain access to much of the plays that have yet to be discovered. As we progress in the direction of needed acceptance, we must consider the reasoning behind the need for access and what implications it may bring. â€Å"The U. S. Energy and Information Administration (EIA) reports that over 750 trillion cubic feet of technically recoverable shale gas and 24 billion barrels of technically recoverable shale oil resources in discovered shale plays exist† (EnergyFromShale, 2012). This knowledge should propel us to continue to esearch necessary ways of extracting such a rich resource. However, within the last 50 years, there has been a means of retrieving this valuable resource for our future existence and economic progress. This activity has been possible through the actions of many drilling companies by the use of hydraulic fracturing. Hydraulic fracturing is a unique way to obtain the oil reserves by drilling in a horizontal pattern and gaining access to those many billion barrels of oil and natural gas waiting to be released.First, we must completely understand what hydraulic fracturing is and what it represents to the public. â€Å"Hydraulic fracturing is the process of drilling for natural gas and oil underneath the ground. Water mixed with other  components is pumped into the ground to create cracks (also referred to as fissures or fractures) to release the gas into wells that have been built for collection† (WhatIsFracking, 2013). As the fog of understanding is slowly starting to lift, we again have to understand that there is a process, in which this occurs and will be noted in later pages, as to the affects of this procedure.Note that this has not gone on for such a period, as to not be studied and time given to organizing the pros and cons of this operation. In order to gain access to the far reaches of the plays that holds the resource, the utilization of various fluids and sand is used in th e process. It is vital to comprehend the need for monitoring the steps, as they occur and the overall engagement of the wells development. Steps are established, for this must have a great deal of regulatory involvement, while the entire flood of activity occurs. Water, sand and additives are mixed at the surface and pumped at high pressures down the wellbore. The fracturing fluid flows through the perforated sections of the wellbore and into the surrounding formation, fracturing it while carrying sand or proppants into the cracks to hold them open. Experts continually monitor pressures and fluid properties during the process, and adjust operations as necessary. This process is typically completed in multiple sections of the wellbore, commonly referred to as stages.Typically stages are isolated using a plug to allow energy or pressure to be applied to a smaller portion of the formation to help maximize the fractures created in the target formation. The plugs are removed from the wel lbore and the well’s pressure is reduced during the flowback process, leaving the sand in place to prop open the cracks and allow natural gas and oil to flow. Naturally occurring produced water, collected during the flowback process and throughout the life of the well, is properly disposed of or treated and re-used in the next hydraulic fracturing operation† (Chesapeake Energy, 2013).As the process dictates, it is very in-depth and must have an enormous amount of oversight, in order to accommodate the issues that may arise during any given point. Now that we have a clearer picture of the process, we should learn of the historical track that played out, in the early days. The first recorded effort to gain access to the plays that hold the natural gas and oil deposits was in the year 1947 by Pan American Petroleum Corp. This was noted as being a test platform, in which there was to be hydraulic fracturing compared directly with acidizing.This well, located in Grant County , Kansas, home of the Hugoton field Kelpper Well No. 1, was used as a tool for simulation productivity of oil and natural gas wells (Society of Petroleum Engineers, 2012). As time progressed, it became more and more popular, as a greater amount of drilling companies began to see the possibilities and growth potential in this process. Now we find ourselves faced with several years of activity and lessons learned to cope with, from various issues that have found their way to the open public.After many years of hydraulic fracturing and the horizontal drilling effort, there have been noted disruptions by what has been occurring through the need to extract methane from the shale rock. Therefore, further analysis is necessary to investigate the potential cause of all the reports being tethered through local, state, and the federal governments. The impact of this drilling weighs heavily on the residents that are local to the drilling process.The concerns stem from the possibility of contam ination that may be chiefly caused by the various fluids that are transferred through the well system, in order for the fracturing process to transpire. There is great concern that life threatening incidents may be a great risk to the area being fracked. With this issue and many others on the horizon, the Environmental Protection Agency has been very inclusive in all the debate. Through many regulatory policies and formal laws, there have been continued discussions, in regards to hydraulic fracturing.Before we discuss the major policies that have been implemented, it is necessary to bring about the detailed issues that have raised such awareness. An astronomical amount of reports had perforated the airways and given some reason for there to be fear in most of the residents’ eyes, when it could affect their very living conditions and livelihoods. â€Å"Areas of concern include perceived lack of transparency, potential chemical contamination, water availability, waste water di sposal, and impacts on ecosystems, human health and surrounding areas† (University of Michigan, 2012).The potential for there to be a complete downfall of an industry that had found an answer to locating and retrieving the well needed resource was now at the forefront of controversy and having to prove its place in this progressive economy. The report would continue to show the prospects of being an enormous loss to the residents of Michigan. â€Å"Hydraulic fracturing has the potential to touch issues that virtually all Michigan residents care about: drinking water, air quality, Great Lakes health, water supply, local land use, energy security, economic growth, tourism and natural resource protection,† Hoffman said. In the end, our goal is to provide valuable insights and information to help address these important and legitimate concerns here in the Great Lakes State† (University of Michigan, 2012). The reports would not stop here, they would continue around the nation. â€Å"A U. S. Geological Survey (USGS) report found traces of methane, ethane and phenol in a monitoring well in rural Pavillion, Wyo. , where residents say fracking has contaminated their drinking water† (Colman, 2012). As noted, this was going to be a continual issue, needing mitigation and regulation by an appropriate authority.Along with this report came other stories, following the same circumstances and leading to the same conclusions. At this point there needed to be an in-depth study to completely comprehend the issues that have drawn so much limelight and bring about a report that would lead to the needed answers and come to some final conclusions. This is where the United States Environmental Protection Agency (EPA), along with the Department of Energy (DOE) and the Department of Interior (DOI) came together in an multi-agency agreement to work toward efforts to engage this potential problem. In March 2011, the White House released a â€Å"Blueprint for a Secure Energy Future† (Blueprint) –a comprehensive plan to reduce America's oil dependence, save consumers money, and make our country the leader in clean energy industries. The Blueprint supports the responsible development of the Nation's oil and natural gas, with the specific goals of promoting safe practices and reducing energy imports. The Department of Energy (DOE), the Department of the Interior (DOL), and the Environmental Protection Agency (EPA) each will have a critical role to play in this mission† (Majumdar, A. Hayes, D. J. , Perciasepe, B. , 2012). Marching orders were therefore given to the multi-agency force and each would take measures, as to not go into redundancy and use each other’s fields of expertise and resolve conflicts, as they arose. As the EPA will continue to work in a multi-agency capacity to continue learning answers from their in-depth study, it is important to know that they did do an earlier study in 2004 on underground sourc es of drinking water, as it referred to hydraulic fracturing.While the main portion of the fracturing is conducted in a particular place, many of the other sections of vertical and horizontal well sections may be set up over several thousands of feet away. â€Å"Fluids, commonly made up of water and chemical additives, are pumped into a geologic formation at high pressure during hydraulic fracturing. When the pressure exceeds the rock strength, the fluids open or enlarge fractures that can extend several hundred feet away from the well.After the fractures are created, a propping agent is pumped into the fractures to keep them from closing when the pumping pressure is released. After fracturing is completed, the internal pressure of the geologic formation cause the injected fracturing fluids to rise to the surface where it may be stored in tanks or pits prior to disposal or recycling. Recovered fracturing fluids are referred to as flowback. Disposal options for flowback include disc harge into surface water or underground injection.Surface water discharges of the flowback  are regulated by the National Pollutant Discharge Elimination System (NPDES) program, which requires flowback  to  be  treated prior to discharge into surface water or underground injection prior to discharge. Treatment is typically performed by wastewater treatment facilities. Underground injection of flowback is regulated by either EPA Underground Injection Control (UIC) program or a state with primary UIC enforcement authority. Injection of natural gas production wastes would be considered a Class II injection well† (Environmental Protection Agency, 2012).As seen, there are restrictions in place to prevent any issues with contaminants from ground water penetration. Even with these restrictions in place, there are clear indicators that there is a more graphic understanding what is coming out, as a result of fluids being pressurized through the system. â€Å"Along with the int roduced chemicals, hydrofrac water is in close contact with the rock during the course of the stimulation treatment, and when recovered may contain a variety of formation materials, including brines, heavy metals, radionuclides, and organics that can make wastewater treatment difficult and expensive.The formation brines often contain relatively high concentrations of sodium, chloride, bromide, and other inorganic constituents, such as arsenic, barium, other heavy metals, and radionuclides that significantly exceed drinking water standards† (danps, 2011). There needs to be a very serious conversation of how this is cleaned up and an answer, as to whether it is enough. There is clearly a lot of work put into the actual cleaning of the ground water, prior to the actual point, in which we, as citizens are able to partake of the needed substance for consumption. No matter how clean it is when you actually consume it, the process of getting to it is unbelievably dirty. Even the USGS acknowledges as much: â€Å"While the technology of drilling directional boreholes and the use of sophisticated hydraulic fracturing processes to extract gas resources from tight rock have improved over the past few decades, the knowledge of how this extraction might affect water resources has not kept pace† (danps, 2011). This is only one aspect of where this all goes.So many other areas of research are in need, to better understand the process, in which the fracturing is utilized. Further research was conducted and it was through the use of several interviews and questioning of a myriad of employees from various locations, concerning the extraction of Coal Bed Methane† (CBM). EPA researched more than 200 peer-reviewed publications, interviewed approximately 50 employees from industry and state or local government agencies, and communicated with approximately 40 citizens and groups who are concerned that CBM production ffected their drinking water wells† (United States Environmental Agency, 2004). After the many reviews and interviews conducted, the EPA came to some conclusions and presented them in chapter 7 of this current report. â€Å"Hydraulic fracturing may have increased or have the potential to increase the communication between coal seams and adjacent formations in some instances. For example, in the Raton Basin, some fracturing treatments resulted in higher than expected withdrawal rates for production water.Those increases, according to literature published by the Colorado Geologic Survey, may be due to well stimulations creating a connection between targeted coal seams and an adjacent sandstone aquifer (Hemborg, 1998). In the Powder River Basin, concerns over the creation of such a hydraulic connection are cited as one reason why hydraulic fracturing of coalbed methane reservoirs is not widely practiced in the region. Some studies that allow direct observation of fractures (i. . , mined-through studies) also provided evidence that fractures move through interbedded layers, sometimes taking a stair-step path way through complex fracture systems, and sometimes enter or propagate through geologic strata above the coal† (United States Environmental Agency, 2004). The EPA finished out their report with concluding comments that were found to be not as alerting than what might have been expected. Based on the information collected and reviewed, EPA has concluded that the injection of hydraulic fracturing fluids into coalbed methane wells poses little or no threat to USDWs and does not justify additional study at this time. Although potentially hazardous chemicals may be introduced into USDWs when fracturing fluids are injected into coal seams that lie within USDWs, the risk posed to USDWs by introduction of these chemicals is reduced significantly by groundwater production and injected fluid recovery, combined with the mitigating effects of dilution and dispersion, adsorption, and potentially biodegradati on.Additionally, EPA has reached an agreement with the major service companies to voluntarily eliminate diesel fuel from hydraulic fracturing fluids that are injected directly into USDWs for coalbed methane production† (United States Environmental Agency, 2004). Several other reports came into sight, throughout the country concerning the use of hydraulic fracking and the potential for impacting, not only the land, but the economy for a given area, as well. Reports stemming from a community that namely has an array of vineyards for the production of wine, have thrown a red flag of concern over the entire region.This rise of apprehension over their displeasure of drilling companies simply ushering themselves in and going to work on their well, without concern for the nearby residents and their land. The mounting anxiety over this issue has occurred from the noticeable problematic reports of events that literally sprang up in the area. â€Å"This past June, a methane geyser was found in Pennsylvania’s Tioga County. Yes, a geyser — shooting methane-infused water 30 feet up in the air.Once the geyser was discovered, the county immediately turned to Shell, which was drilling in three nearby locations. Shell and the Department of Environmental Protection began investigating, and it was correctly suspected that an abandoned well from the 1930s contributed to the problem† (Figueroa, 2012). This, being an erroneous event was later found to be an old existing well from the 1030s, where the fluid from a nearby well, being hydraulically fractured, leaked over near the old well and burst up through it, creating the 30 foot geyser.There too, have been issues regarding the location of the wells near vineyards and the potential for disruption in the soil content and an economical impact, for the soil is worked to contain the right content for growing the vines for the fine wine. As well, if the land soil is tainted, there is a possibility of an econo mic suffering from the loss of profit if tastes change and are possibly contaminated. â€Å"Vineyard owners in California are  growing increasingly wary  of fracking as gas companies begin preliminary operations. Venoco has started exploring Monterey Shale for both oil and gas drilling.Last year, the company filed an application for drilling permits in Monterey County, according to Simon Salinas, a member of the county’s Board of Supervisors, and it already holds hundreds of thousands of acres in the formation has drilled more than 20 wells and has invested $100 million in oil exploration. With vineyards and farmlands covering 200,000 acres of Monterey that help make up an $8 billion agricultural business, Salinas told the  Pittsburgh Post-Gazette, â€Å"Anything that can taint our water and food supply could be devastating to our economy† (Figueroa, 2012).Reports even go deeper than this, where there are believed to be detrimental damage and even death to anima ls that are near any wells in the area. It may be a reality as more and more livestock are raised near fracking sites. Hundreds of animals have already been  affected  after coming into contact with fracking fluid. â€Å"Last year, 28 beef cattle in Pennsylvania were exposed to the fluid. Only three of the 11 calves these cattle gave birth to survived. In Louisiana a few years ago, 16 cows dropped  dead  after drinking fracking fluid† (Figueroa, 2012).These are all alarming reports and individuals that are in the area have every reason to be upset and concerned over the events taking place. The question is, does this warrant further investigation or simply better legislation to control the problem or the potential, there of? As all of this sounds incredibly scary and one may ask the whereabouts of such legislation, it is understood that all the problems that have come about, are those that have mostly to do with water and how it affects surrounding land and the owners .This, being the case is under the written regulations of the Safe Water Drinking Act (SWDA) Underground Injection Control (UIC) Program. The UIC program has developed certain guidelines for all involved with the use of a fluid injection process to extract the shale oil and natural gas that is so plentiful, throughout our region. The guideline begins the use of diesel fuel for the injection process, in the following statement: â€Å"EPA has developed draft Underground Injection Control (UIC) Class II permitting guidance for oil and gas hydraulic fracturing activities using diesel fuels.This document describes information useful in permitting the underground injection of oil- and gas-related hydraulic fracturing using diesel fuels where EPA is the permitting authority. EPA's goal is to improve compliance with the Safe Drinking Water Act (SDWA) requirements and strengthen environmental protections consistent with existing law† (United States Environmental Agency, 2012). There i s further guidance, in regards to the injection of possible contaminants that may affect ground water supplies, as dictated by the process from hydraulic fracturing.Through the National Pollutant Discharge Elimination System (NPDES), which is authorized by the Clean Water Act, the following claim states, â€Å"industrial, municipal, and other facilities must obtain permits if their discharges go directly to surface waters† (United States Environmental Protection Agency, 2009). Until further guidance comes out of the primary study, presently occurring, there seems to be a number of statutes in place to maintain a great deal of oversight and must be used to maintain what has continued to draw an enormous amount of controversy and surely will continue throughout the course of the process.The new study is to take a look at the vastness of what water goes through, during the hydraulic fracturing process. This being the call from congress, for the EPA to utilize its resources to re ad deep into the full cycle, in which the water passes, as it is used in the extraction of oil and natural gas from the shale plays. â€Å"At the request of Congress, EPA is conducting a study to better understand any potential impacts of hydraulic fracturing on drinking water and ground water.The scope of the research includes the full lifespan of water in hydraulic fracturing, in regards to five primary points; the plan to study the potential impacts of hydraulic fracturing on drinking water resources, an approach to the science, quality assurance ; integrity, a peer review, and the transparency of the practice† (United States Environmental Protection Agency, 2012). The complete final report will not be made available until 2014, where it will be made public for review and comment.Before this final report makes its way to the public, the EPA has issued an official progress report and has detailed the path that the study will go, as far as, how it will attain complete unders tanding of the process that water takes through the lifespan of hydraulic fracturing. The EPA is using computer model to match the conditions, in which the water travels through hydraulic fracturing. It will be identified through hypothetical and realistic scenarios, by which water acquisition, well injection, and wastewater treatment and waste disposal stages of the water cycle are identified and given fair study and representation.All of this is being addressed as it relates to the Upper Colorado River Basin in the west and the Susquehanna River Basin in the east (US Environmental Protection Agency Office of Research and Development Washington, DC, 2012). While it has been thoroughly discussed, as to the potential causes of awareness and a reason for alert, it is paramount that we discuss the hopeful answer to the issues that have been raised. There may be a possible olution, regarding the practice of hydraulic fracturing and horizontal drilling; it may simply be an overall accept ance, until regulations can be the agreeable key to a solid outcome of this environmental squeeze on reality. Before we get to a proposed solution to the mind raking issues that have plagued this storyline, there is a cost to all of this and a place to put the responsibility on the shoulders of the bearers to this environmental struggle for clarity.With fracking, being a well spread operation and bringing with it a toll of polluted areas, such as water, air, and torn up land across the nation, we are faced with the need to not only find resolution to this growing land grievance, but we need to recognize that there must be a means of restoration to the areas effected and the costs associated, dealt with during the process. Let it be known there is a high price tag in pursuing a cleanup and hopeful reversal of the damage done by the fracturing. Methane contamination of well water poses a risk of explosion and is often addressed by removing it from water at the point of use. In Dimock, Pennsylvania, Cabot Oil ; Gas reported having spent $109,000 on methane removal systems for 14 local households in the wake of drilling-related ethane contamination of local groundwater supplies. In addition, the company spent $10,000 on new or extended vent stacks to prevent the build-up of methane gas in 17 residents’ homes.Such measures do not remove methane from groundwater supplies, but merely eliminate the immediate threat to residents’ homes† (Tony Dutzik and Elizabeth Ridlington, Frontier Group John Rumpler, Environment America Research ; Policy Center, 2012). However, water is not the only issue that is under the gun, there is also the effect that each fracking site has on the air surrounding it. The air we breathe highly contributes to the health of all those associated with residency in the area of drilling. A 2004 Environmental Protection Agency (EPA) document, referring to the work of a Federal roundtable on environmental cleanup technologies, estim ated the cost of air sparging at $150,000 to $350,000 per acre. Adjusting for inflation, and assuming that the extent of the seep was correctly estimated by Encana at 1. 3 acres, one could estimate the cost of the sparging operation in 2012 dollars at $248,000 to $579,000. In addition, as of May 2012, Encana and its contractors had collected more than 1,300 water samples since the seep began. Again, the cost of this sampling and testing is unknown, but could e conservatively estimated to be in the tens of thousands of dollars. Cabot Oil ; Gas, for example, incurred $700,000 in water testing expenses in the wake of concerns about groundwater contamination from a fracking well in Dimock, Pennsylvania† (Tony Dutzik and Elizabeth Ridlington, Frontier Group John Rumpler, Environment America Research ; Policy Center, 2012). In order for the companies out there that are working toward reducing the amount of pollution coming from fracking, they are looking at a high rate of dollars to keep it at a minimum. The clearance of forest land in Pennsylvania for fracking is projected to lead to increased delivery of nutrient pollution to the Chesapeake Bay, which already suffers from a vast nutrient-generated dead zone. The cost of reducing the same amount of pollution as could be generated by fracking would be approximately $1. 5 million to $4 million per year† (PennEnvironment Research ; Policy Center, 2012). It is important, not only to understand what it takes to cleanup at an actual location, but the cost incurred through repairing the lanes to the site, because of the variety equipment and how it damages the roadways. The truck traffic needed to deliver water to a single fracking well causes as much damage to local roads as nearly 3. 5 million car trips. The state of Texas has approved $40 million in funding for road repairs in the Barnett Shale region, while Pennsylvania estimated in 2010 that $265 million would be needed to repair damaged roads in the Marc ellus Shale region† (PennEnvironment Research ; Policy Center, 2012). Infrastructure is important to have an ability to get to the site and out of the site safely, however there is a cost, when it comes to the other friends of our environment. Fracking has several negative impacts on farms, including the loss of livestock due to exposure to spills of fracking wastewater, increased difficulty in obtaining water supplies for farming, and potential conflicts with organic agriculture. In Pennsylvania, the five counties with the heaviest Marcellus Shale drilling activity saw an 18. 5 percent reduction in milk production between 2007 and 2010† (PennEnvironment Research ; Policy Center, 2012). This, being only one part of the issue, we also must consider the other end of the animal kingdom, our wildlife in the wilderness. Gas operations in Wyoming have fragmented key habitat for mule deer and pronghorn, which are important draws for the state’s $340 million hunting and w ildlife watching industries. The mule deer population in one area undergoing extensive gas extraction dropped by 56 percent between 2001 and 2010† (PennEnvironment Research ; Policy Center, 2012). In this great land of ours, we are living in a generation that now must deal with a new healthcare system and be able to still afford the normal living expenses that come our way.With healthcare cost rising and now the fight for the issues that have been rising over the industrialization of our resource gathering techniques, we are at the foothills and must climb up and rise above the extraneous costs that come from this means of extraction. â€Å"Drinking water contamination:   In Dimock, Pennsylvania, permanently replacing residents’ contaminated drinking water with a new source was estimated at more than $11 million and health costs from air pollution:   in Arkansas’ Fayetteville Shale region, air pollution from fracking operations impose health costs estimated at $9. million in one year. In Texas’ Barnett Shale region, those costs reach $270,000 per day during the summer smog season† (Environment America, 2012). This now seems, as though it is not going anywhere anytime soon, so where is a possible solution to this environmental peril we find ourselves in? Is there an answer? Or are we destined to sit and wait for an answer that may never come. Now, we find ourselves staring at a withering wilderness without any better days likely to come over this industrialized beat down.Now that there is a more comprehensive understanding of what fracking is all about and the impact it has on the environment directly and indirectly, through the social health issues, we must be able to curtail what is being identified as hazardous and stop it in its tracks. In order for this to occur, shouldn’t there be a means of determining the location of where the fracking fluid is mostly traveling, so we can diffuse the situation and potentially protect the surrounding regions from contamination and the spread of this devastating spiral of events.Having a way to track where the fluid travels is one of the possible solutions to keeping the public safe from the probability of causing more harm among our citizens. â€Å"Currently, there is little courts can do to determine the truth of claims that fracking contaminates waterways. One popular suggestion, proposed by many stakeholders and creative scientists, is to include some type of tracer device, such as a color or a chemical, to follow fracking fluids through the environment.This solution wouldn’t track the leaching of natural gas through old mines or fissures, but it would help companies, overseers, and policy-makers understand how chemicals flow deep underground, especially when multiple companies are drilling in one area. Such tracers would hold companies accountable to the environment, to landowners, and to stakeholders† (Lamers, 2012). The question is, w ould this continue to add to the already polluted scene, or would it meet a solution to have a better understanding, as to the route this fluid seems to take to contaminate our groundwater systems?We also may have an opportunity to set stricter laws, as to the actual location of these wells, in relation to it being positioned within residential areas. â€Å"Policies and recommendations vary widely about how close shale gas sites should be to lakes, rivers, ponds, houses, wetlands and protected areas. As many counties and states begin to lease or sell land, drill sites are beginning to cross into state or county parks and pass into or through rivers and streams† (Lamers, 2012).Having the ability to force drilling companies to be at a particular range from any residential or other protected area would be a promising solution to creating safer barriers for the general population and individual wildlife areas to be safe from the untidiness of a fracking site. While we look for th e government to come up with more legalistic approaches to this devastating thorn under the environments skin, maybe the answer is more profound and can be drawn from unique sources, rather than a traditional loom. â€Å"Most of the water used to free the gas and oil is trapped underground.But a new option is to swap water for propane gas, which is then recaptured as it escapes from the earth. Canadian company GasFrac Energy Services is already employing propane instead of water. A single fracking job can use between two million and six million gallons of water while most of that water remains underground, the fluid that does return to the surface has to be disposed of as contaminated wastewater† (Stone, 2011). Another approach is found to be one of the greenest found, to date. Not only is the amount of water being reduced, but the solution involves utilizing a biodegradable source to accomplish a safe means of eusing this product. â€Å"Houston-based oil field supplier Flot ek Industries has found another solution that replaces traditional chemicals with extract from orange peels, turning the conventional mixture of water and toxins into a biodegradable blend† (Stone, 2011). This idea opens up a whole new scheme in the desire to continue our search for self sustainment and future drilling opportunities. However, it is not the only solution to hit the community, as there has been something stirred up in the Halliburton camp with the utilization of solar panels and electricity making its way to the oil fields. Halliburton calls its two-year-old solar-powered invention the SandCastle. It has rolled out dozens of SandCastles in the U. S. By replacing diesel engines to move sand from the trailers, Halliburton estimates the devices have saved 950,000 gallons of diesel and reduced carbon dioxide emissions by 20 million pounds in the first nine months of 2012. Halliburton and the other three largest oil-field service providers spent $2. 04 billion on res earch and development in 2011, up 32 percent from two years earlier. Some of that went to finding ways to make fracking more eco-friendly.Other green-leaning players include Chesapeake Energy (CHK) and General Electric (GE), as well as oil-patch interlopers such as Verenium (VRNM), a biotech concern, and Ecologix Environmental Systems, which makes wastewater-treatment systems† (Wethe, 2012). What does all of this mean? It simply means that drilling companies are seeing the need to make changes to the way they conduct business, so as it does not interfere with our environment anymore. It means that we can no longer stand by, as residents of this great land of ours and simply be good with how they conduct their business.It means that, we the people of this beautiful landscape we call planet earth, have a voice and will be heard. It means, as long as we celebrate our land together as citizens, we have the aptitude to develop the means necessary, to guide the direction, in which w e will continue to move forward. As mentioned at the beginning of this paper, we will continue to dream of that new discovery, launching us into a new direction. The Reconstruction Era Jessica Onken American History Since 1865 Professor Tim Johnston August 2, 2010 Reconstruction 2 The Reconstruction Era The reconstruction era was a difficult time for the African American slaves from 1865 to 1877 because the slaves were freed and there were no jobs for them, had very little or no education, and had very limited opportunity in the south. Reconstruction was one of the most critical periods in American History. The Civil War changed the nation tremendously, and most importantly by bringing an end to slavery.Reconstruction was a period of great promise, hope, and progress for African Americans, and a period of resentment and resistance for many white southerners. The time period for the Reconstruction era was in 1865 to 1877, when the United States was rebuilding and reuniting after the Civil War. In 1865, four years of brutal deconstruction in the Civil War came to an end, 600,000 American soldiers lost their lives. Four million enslaved African Americans were emancipated. The south was laid to waste; railroads, factories, farms, and cities were destroyed.Abraham Lincoln was elected president during that time. Abraham Lincoln knew once the states confederacy were restored to the union, the Republicans would be weakened unless they put an end to being a sectional party. Lincoln hoped for peace and to attract people of the former south who supported the Republicans' economic policies. During the Era of Reconstruction, it was highly unstable because while many Northerners saw this as a chance to completely end slavery and have the south merged back into the United States, many in the south saw this as an insult and another injury of the loss of the Civil War.Lincoln's plans during this time were to free more slaves and grant freedom. At the end of the Reconstruction Era, freedoms were granted under the 13th, 14th, and 15th Amendments, but were not completely effective. The moral views through religions before and after the war of the north and south Reconstruction 3 were different. With different opinions flowing, the Presbyterian and Methodist churches split into Northern and Southern functions. The Southern churches supported slavery and believed that it was also supported by the Bible.The north believed that no man should be held in captivity or confinement by another man. The north wanted to end slavery but still most of the Northerner did not consider the black man to be equal to them. There were some Northerners that did believe all men are created equal. Some Northerners showed strong emotions about the eradication of slavery that they became violent. Most of the Northerners did not change after the war, which caused the segregation that continued until the 1960's.In 1865, the Ku Klux Klan was started in Tennessee to stop blacks from taking advantage of their new rights. Members from the Ku Klux Klan would beat and murder blacks to keep them from having rights. Northern soldiers were stationed in the south to enforce the Reconstruction laws. The soldiers made sure blacks could vote in elections, be treated just like the white people, go to school, and they were also there to prevent any attacks from happening by the southern whites. In 1869, the Southern governments started to end control by the North in Tennessee and Virginia.Some of the power of the Southerners was regained to run their own state governments, which made the Northerners have less influence on the southern governments. The reason for the southerners joining the Ku Klux Klan was because they did not want blacks to have rights such as voting, owning land, freedom, be treated fairly at jobs, participate in court trials, run for office, etc.. Southern white people were not for reconstructing governments. They would not accept the black men that were once slaves as free black men who now had the right to Reconstruction 4 vote and participate in state government.As the nation started to celebrate the end of the wa r in April 1865, president Lincoln was shot and killed After Lincoln was assassinated, Andrew Johnson took over the process of the reconstruction. Johnson made the reconstruction less efficient. He forgave some ex-confederates and didn't take the same steady approaches as Lincoln did. Johnson was a southerner, and like Lincoln, a self educated man who climbed up the ladder from an inferior decent. Southerners were now making new laws called black codes, which meant it made blacks' lives harder and to prevent them from using their new rights.Some codes forced blacks to work for a year, and if they didn't, they were thrown in jail for being unemployed, and also let them be whipped by their bosses. By enforcing labor contracts, and laws, the strict black codes kept freedmen tied to the plantation. This period was described as violence, revenge, retaliation, and eye for an eye against African Americans. The justice system of the south provided no refuge or assistance. The all white poli ce force frequently terrorized African Americans, and the judges and other officials rarely prosecuted crimes against blacks.When the news of the black code laws and the violence against the freedmen spread to the North, it created outrage and fury. When the Northern soldiers were not positioned in the south to enforce Reconstruction laws, blacks had to live under the unpleasant, cruel, and unfair conditions caused by the black code laws. Johnson allowed the black codes to be passed which imposed heavy restrictions on freed African American slaves. Johnson was against the passage of a renewal of a new Freeman's Bureau, which served as a positive organization for African Americans,Reconstruction 5 which would have allowed the black war veteran's the right to vote. In 1867, Congress passed a new Reconstruction Act, that threw out the state governments of states that refused to ratify the 14th amendment. The 15th amendment was ratified in 1870, providing a constitutional guarantee of v oting rights for African American males. By 1870, the Northerner lost interest in reconstructing the south. The north tried to reconstruct the south and change southerners attitudes about black people.Although they failed at this because many southerners were still racists and believed that the white race was superior to others, blacks were not as good as southern white men. To add to that, the Northerners lost interest in the reconstruction, which gave southerners a chance to gain control of their state governments again. The main complaints against the Presidential Reconstruction were the Radical Republicans of Congress. New political forces in the South gave way for new changes. During reconstruction, African Americans made huge political gains.They voted in large numbers and were also elected to political office. African Americans were elected as sheriffs, mayors, legislators, Congressmen, and Senators. Even thought their participation was significant, it was exaggerated by whit e southerners angry at the Black Republicans governments. Reconstruction governments built public schools for both black and white children. They also rebuilt and added more railroads, telegraph lines, bridges, and railroads. These costly efforts led to tax increases that made the southern whites more angry, which was why the Ku Klux Klan was created.By the mid 1870's, the Republicans were losing power, and the Northerners were tired of trying to reform the south. In 1872, Congress passed the Amnesty Act, which reinstated voting rights to almost all white southerners. By 1876, almost all southern s Reconstruction 6 states were back under the control of the Democrats. When Rutherford B. Hayes was elected president in 1877, the reconstruction came to an end. He removed the remaining federal troops from the south. With no one left to enforce the reconstruction reforms, the Reconstruction was over. White Democrats remained in control of southern governments.Southern states denied Africa n Americans from voting through voting restrictions such as the poll tax, grandfather clause, and the literacy test. Jim Crow Laws separated blacks and whites in restaurants, schools, theaters, railroads, hospitals, and all other public places. The Jim Crow Laws were clearly passed to ensure that black people could not dot eh same things as white people. Such laws encouraged and promoted racial segregation and varied from district to district. Some required black people to drink at separate fountains and use separate bathrooms than white people.Others required black people to give up seats on public buses if a white person wanted their sear, and still others prohibited black people from attending the same schools as white people African Americans continued to be looked at as â€Å"bad†or not â€Å"equal† as the white Americans. They were still victims of violence and intimidation. In the 1960's, with the Civil Rights movement, the African Americans were granted full pr otection of the 14th and 15th amendments. The period of the Reconstruction was one of great promise for the United States and for African Americans.During this period, African Americans continued to struggle for freedom and worked to improve their communities. Institutions of the African American community like the churches and schools were strengthened over time. Though there were long term consequences of Reconstruction failures, the Reconstruction era provided a Constitutional basis for later attempts to end discrimination. Portia in Shakespeare's 'The Merchant of Venice' Portia in Shakespeares The Merchant of Venice is one of the Bards most beloved characters. The Love Test Portias fate is determined by the love test her father gives to her suitors. She is unable to choose her own suitor but is forced to marry whoever passes. She has wealth but has no control over her own destiny. When Bassanio passes the test, Portia immediately agrees to divest all her riches, property, and power over to him in order to be his loving and dutiful wife. She is passed from one man’s control- her father’s- to another- her husband’s: As from her lord, her governor, her king.Myself and what is mine to you and yoursIs now converted: but now I was the lordOf this fair mansion, master of my servants,Queen oer myself. And even now, but now,This house, these servants and this same myselfAre yours, my lord’s (Act 3 Scene 2, 170-176). One wonders what is in it for her... other than companionship and, hopefully, love? Let’s hope that her father’s test really is foolproof, in that the suitor is proven to love her through his choice. As an audience, we know the lengths to which Bassanio has gone to win her hand, so this gives us hope that Portia will be happy with Bassanio. Her name is Portia, nothing undervaluedTo Cato’s daughter, Brutus’ Portia.Nor is the wide world ignorant of her worth,For the four winds blow in from every coastRenowned suitors, and her sunny locksHang on her temples like a golden fleece,Which makes her seat of Belmont Colchis’ strand,And many Jasons come in quest of her (Act 1 Scene 1, 165-172). Let’s hope Bassanio is not just after her money but, in choosing the lead casket, we are to assume he is not. Character Revealed We later discover Portia’s true grit, resourcefulness, intelligence, and wit through her dealings with Shylock in court, and many a modern audience might lament her fate at having to go back to court and be the dutiful wife she promised to be. It is also a pity that her father did not see her true potential in this way and, in doing so, he may not have determined his ‘love test’ necessary but trusted his daughter to make the right choice off her own back. Portia ensures that Bassanio is made aware of her alter ego; in disguise as the judge, she makes him give her the ring that she has given him. In doing so, she can prove that it was she posing as the judge and that it was she who was able to save his friend’s life and, to and extent, Bassanios life and reputation. Her position of power and substance in that relationship is therefore established. This sets a precedent for their life together and allows the audience some comfort in thinking that she will maintain some power in that relationship. Shakespeare and Gender Portia is the heroine of the piece when all the men in the play have failed, financially, by the law, and by their own vengeful behavior. She swoops in and saves everyone from themselves. However, she is only able to do this by dressing up as a man. As Portia’s journey demonstrates, Shakespeare recognizes the intellect and abilities that women have but concedes that they can only be demonstrated when on a level playing field with men. Many of Shakespeare’s women show their wit and cunning when they are disguised as men. Rosalind as Ganymede in As You Like It is another example. As a woman, Portia is submissive and obedient; as the judge and as a man, she demonstrates her intelligence and her brilliance. She is the same person but is empowered by dressing as a man and, in doing so, she hopefully gains the respect and equal footing she deserves in her relationship: If you had known the virtue of the ring,Or half her worthiness that gave that ring,Or your own honour to contain the ring,You would not then have parted with the ring (Act 5 Scene 1, 199-202).

Southwest Airlines’ tenacity is very distinctive and they are proud to show it through their marketing campaigns, such as, â€Å"Nobody Is Going to Shoot Southwest Airlines Out of the Sky for a Lousy $13. † The value Southwest Airlines has for its employees is impressive. The low employee turnover rate and large number of applicants is a strong indicator that this value is real and not lip service. Another interesting fact in regards to employees at Southwest is that in 40 years there have only been four CEOs, with 20 of those years being one individual, Herb Kelleher. 2. What grade would you give Southwest management for the job it has done in crafting the company’s strategy? What is it that you like or dislike about the strategy? Does Southwest have a winning strategy? In respect to Southwest’s efforts in crafting the company’s strategy, we feel that the company deserves an A for its relentless efforts to stay true to its low-cost provider strategic intent and for its ability to be able to achieve a sustainable competitive advantage. As customers, we feel like the low prices are an extremely likeable aspect of the strategy. It is also important to mention that their customer service level is strong and leaves each passenger feeling a connection with the Southwest brand. However, we dislike the lack of creature comforts and the cattle-like approach to boarding. Southwest does maintain a winning strategy. One of the most important concepts that Southwest developed and grasped in their strategy was that it was not enough to be a low-cost provider; they needed to have a sustainable competitive advantage. The company addressed this by stressing that through the low-cost provider strategy, customer service, and customer satisfaction, they are able to achieve a sustainable competitive advantage, which is demonstrated in their financial and statistical data. A manager from Southwest stated â€Å"our fares can be matched; our airplanes and routes can be copied. But we pride ourselves on our customer service. † Although no strategy is without fault or mistake, Southwest has managed to significantly make its strategy into one that can thrive in both a short and long-term vision. With its focus on ways to keep cost low for customers, from paperless tickets to special programs for frequent flyers, the company has been able to effectively provide service to their customers and hold true to their mission. 3. What are the key policies, procedures, operating practices, and core values underlying Southwest’s efforts to implement and execute its low-cost/no frills strategy? Southwest has many key policies, procedures, operating practices and core values that help to implement and execute its low-cost/no frills strategy. Fare Structure: Southwest employs a relatively simple fare structure featuring low, unrestricted, unlimited, everyday coach fares, along with even lower fares available on a restricted basis. Route System: Southwest did not use the hub-and-spoke route systems like their rivals; instead their route system was carefully designed to concentrate on flights between pairs of cities 150-750 miles apart where there was enough passenger traffic that Southwest could offer a sizable number of daily flights. Relationship with Boeing: Southwest operates only one type of aircraft (Boeing 737s) to minimize the size of spare parts inventories, simplify the training of maintenance and repair personnel, improve the proficiency and speed with which maintenance routines could be done, and simplify the task of scheduling planes for particular flights. With their loyalty to Boeing they were able to acquire new aircrafts at favorable prices. Ticketless Travel Option: Southwest was the first major airline to use ticketless travel which eliminated the need to print and process paper tickets. They were also the first to allow customers to make reservations and purchase tickets at their website; this allowed them to bypass the need to pay commissions to travel agents for handling the ticketing process and reducing staffing requirements at reservation centers. Congestion Avoidance: Southwest de-emphasized flights to congested airports which helped them produce better-than-average on-time performance and reduce the fuel costs associated with sitting in line on taxiways or circling waiting for clearance to land. It also allowed them to avoid the higher landing fees and terminal gate costs at such high-traffic airports. No Reserved Seats Policy: To economize on the amount of time it took terminal personnel to check passengers in and to simplify the whole task of making reservations, Southwest stopped assigning seats. No Cleaning Crew: Southwest flight attendants were responsible for cleaning up trash left by deplaning passengers. No First-Class: Southwest does not entertain a first-class section in any of its planes nor do they entertain frequent fliers at fancy clubs in terminals. They also do not serve meals in order to make reprovisioning planes simple and quick. Bags Fly Free: Southwest does not charge a baggage transfer service fee. Software Updates: They implemented use of new software that significantly decreased the time required to generate optimal crew schedules and help improve on-time performance. Vertical Winglets: To enhance the performance and efficiency of the fleet, they added vertical winglets on the wing tips to reduce lift drag, allow aircraft to climb more steeply and reach higher flight levels quicker, improve cruising performance, extend engine life and reduce maintenance costs, and reduce fuel burn. New Technology: Southwest is investing in technology and software to replace its ticketless system and its back-office accounting, payroll, and human resource information systems. This will enhance data flow, operational efficiency, and customer service capability. 4. What are the key elements of Southwest’s culture? Is Southwest a strong culture company? Why or why not? What problems do you foresee that Gary Kelly has in sustaining the culture now that Herb Kelleher, the company’s spiritual leader, has departed? The key element of Southwest’s culture is the total employee benefit package, from compensation to training and development to promotion to retirement. Southwest’s operative principle states, â€Å"employees come first and customers come second. Management believes that by placing a high priority on employees, it would result in those employees being passionate about their jobs, but also lets the employees know that Southwest is concerned for their general well-being and would provide them with job security. It is important to note that Southwest Airlines has never laid off or furloughed any of its employees since beginnin g operations in 1971. Southwest’s simple thesis is as follows: Keep employees happy- then they will keep customers happy. CEO Gary Kelly even said, â€Å"Our people are our single greatest strength and our most enduring long-term competitive advantage. † Southwest is a very strong culture company. By placing their focus on employees first, they are ensuring that their customers will be well taken care of. They hire employees based on their attitude and then train them for skills. Herb Kelleher stated â€Å"We can train people to do things where skills are concerned. But there is one capability we do not have and that is to change a person’s attitude. So we prefer an unskilled person with a good attitude†¦Ã¢â‚¬  Southwest has the belief that superior, hospitable service and a fun-loving spirit flowed from the heart and soul of employees who themselves were fun-loving and spirited, who liked their jobs and the company they worked for, and who were also confident and empowered to do their jobs as they saw fit. Southwest also has the lowest employee turnover rate in the industry with pay scales above the industry average (sometimes even near or at the top of the industry). Another important part of their culture is their no-layoff policy. Kelleher stated â€Å"Nothing kills your company’s culture like layoffs†¦you want to show your people you value them and you’re not going to hurt them just to get a little more money in the short-term. † Southwest has two core values: LUV and fun. LUV turned into the code word for how to treat customers, with dignity and respect and demonstrating a caring, loving attitude. LUV and red hearts appeared on posters at company facilities to remind employees of the behavior that was expected towards customers and other employees. Fun at Southwest includes pranks and jokes, dressing up on holidays, charity benefit games, entertaining behavior of employees while on the job, and more. CEO Gary Kelly explains that the â€Å"Southwest Way†, which includes having a Warrior Spirit, Servant’s Heart and a Fun, Loving attitude are the three things that have defined their culture for 36 years. In 1990, a Culture Committee was formed to nurture the Southwest Spirit. The committee sponsored and supported hundreds of ways to promote the Southwest Spirit by using the red hearts and LUV to embody the spirit of caring and other things such as serving employees pizza. Southwest’s monthly newsletter, LUV Lines, spotlights experiences and deeds of certain employees, reprinted letters of praise from customers, and company milestone celebrations. There are also occasional meetings called Culture Exchange in which they share similar information as the LUV Lines. All of these culture-building exercises have helped Southwest be a profitable company with loyal employees and happy customers. Gary Kelly may still encounter problems after taking over as CEO. Herb Kelleher instituted practices and support systems that promoted operating excellence which were a source of company pride. He devoted many years and a great amount of effort to find the best and most effective ways to operate every aspect of the company, from aircraft maintenance to efficient baggage transfers. CEO Gary Kelly has been following Kelleher’s lead in pushing for operational excellence. Kelly may not be the â€Å"original spiritual leader,† but he is doing his part to keep the company the way Kelleher left it. Kelly has strong strategic objectives; one being that Southwest would be â€Å"the safest, most efficient, and most reliable airline in the world. Both men believed that having a strong balance sheet and profitability were important financial aspects of the company. Kelleher’s vibrant, fun and caring attitude will be hard for any other CEO to match. He was known for his Hawaiian print shirts, making jokes and tricked out motorcycle. He was well known not only inside the company, but also outside for his combativeness. In 1990, he had a message penned in the Dallas Headquarters Office that stated: â€Å"The people of Southwest Airlines are the creators of what we have becomeand of what we will be. † Kelly will never be the same person as Kelleher and it may take longer for employees to warm up to his different management style. Kelly is less of a â€Å"culture pusher† than Kelleher, which could hurt Southwest in the long run, since their whole company is based on promoting a fun, caring atmosphere. Although Kelleher spoke very highly of Kelly when he took over as CEO in 2004, that doesn’t mean that Kelly will be as highly respected in terms of a spiritual leader to employees than Kelleher was. In addition, the Kelleher era at Southwest seemed to always be in a dogfight to build and become what they are today. As the employees who fought that fight with Kelleher retire, a piece of the â€Å"warrior spirit† goes with them. This may make it hard for Kelly to keep the warrior mentality alive with new employees who didn’t have a dog in the fight and may feel they don’t have as much invested to ensure they stay on top. 5. What grade would you give Southwest management for the job it has done in implementing and executing the company’s strategy? Which of Southwest’s strategy execution approaches and operating practices do you believe have been most crucial in accounting for the success that Southwest has enjoyed in executing its strategy? Are there any policies, procedures, and operating approaches at Southwest that you disapprove of or that are not working well? During a difficult time within the airline industry, Southwest made its entrance in 1971, despite the endless attempts from rivals to collapse the company before they could get started. Southwest emerged and made its first flight in June 1971. Since then Southwest’s management team has done a monumental job in implementing their strategies. By using a differentiation approach Southwest was able to stand out amongst its competitors. Low fares, entertainment, more flights to the same locations, the gradual expansion into new geographic markets, adding flights in areas where rivals were cutting back service using first-mover strategies, and flight turnaround times around 25mins (compared to 50-60 minutes from its competitors) all contributed to a grade A for Southwest’s management. Southwest’s overall strategy has transitioned from the 1971 to 2010. When the airline first started, they were serving a market niche in the Golden Triangle (Houston, San Antonio, and Dallas). They moved towards a Focused Low-Cost Provider as they expanded their service by expanding into new geographic markets and adding flights in areas where rivals were cutting back service. Southwest is now moving towards becoming a Best-Cost Provider by upgrading the quality of the customer experience (i. e. leather seats, business-focused areas, family-focused areas, etc). The low-cost, low-price, and no frills strategies have worked very well for Southwest. The company took a two-tier fare approach which gave customers a choice between a low unrestricted, unlimited, everyday coach fare and one which was restricted that was even lower cost. Despite its highly effective strategy, Southwest has some aspects that may not be working as well as others. Their infamous cattle call (procedure for boarding) can make customers feel like animals rather than people when they are fighting for a seat. Many customers may choose to forgo the lower airfare to enjoy a more peaceful boarding experience. Another issue to be addressed is the maintenance policies and procedures that ultimately led to the fairly recent media debacle. Reports of lax aircraft inspections surfaced and Kelly admitted the wrongdoing of the company. He limited the bad media exposure by ensuring the public his airline was one of the safest to fly with. Despite his public apology, this matter needs to be aggressively approached to ensure customers feel safe flying Southwest. 6. What weaknesses or problems do you see at Southwest Airlines? 1. Public perception of safety after airline inspection issue 2. Lack of creature comforts such as pre-assigned seating and on-board meals. 3. There is no first class for customers, so those wanting a more luxurious experience may fly with competing airlines. . It also offers no baggage transfers to other airlines, which may be a complaint from passengers needing to catch another plane in a short amount of time. 5. Cattle-call boarding procedure 7. What recommendations would you make to Gary Kelly? 1. Establish a more aggressive maintenance inspection program, especially with the older aircraft in their fleet. 2. Doing without comfort is fine on short flights. 4. Sell even lower cost tickets to spontaneous travelers who truly decide at the last minute to get away for a short weekend vacation when there are vacant seats available. 5. Continue hedging fuel to save money in that aspect. 6. Explore increasing the number of destination cities so they can grow their customer base. 7.
